Islamabad: The Supreme Court has ordered to hold elections in Punjab and Khyber Pakhtunkhwa within 90 days.

According to the details, the Supreme Court gave a safe decision on the automatic notice case on elections in Khyber Pakhtunkhwa and Punjab.

A five-member bench of the Supreme Court pronounced the decision by a majority of three to two. Chief Justice Umar Atta Bandial, Justice Muneeb Akhtar, Justice Muhammad Ali Mazhar gave the decision in favor of the elections, while Justice Mansoor Ali Shah and Justice Jamal Mandukhel disagreed.

Justice Mansoor Ali Shah and Justice Jamal Mandukhel declared the notice inadmissible.

In the decision of the Supreme Court, it was said that the Election Commission should hold elections in Punjab and KP within 90 days. Elections are an important factor in parliamentary democracy.

The Punjab Assembly was dissolved on January 14 and the KP Assembly on January 18. If the Governor dissolved the Assembly, he can announce the date himself.

Punjab Assembly self-dissolved in 48 hours due to lack of Governor’s signature, even though the Governor did not dissolve the Assembly, elections are required within the stipulated time, Governor KP violated the constitution by not announcing the elections, It is the responsibility of the governor to give the date of election in KP.

The President of the country has announced to hold the elections on April 9, in this situation the Election Commission did not play its role.

As far as Khyber Pakhtunkhwa is concerned, the governor can announce the date, the date of the Punjab election will be given by the president, the election commission is bound to consult with the president and the governor.

In Punjab, if the election is not possible in 90 days, the date can be changed after consultation. If the election cannot be held within the specified period, Article 254 applies.

After reviewing the situation, the Election Commission should suggest a date to the President, it is a constitutional obligation to hold elections within 90 days.

It was not correct for the President to give the date of election for KP, it was absolutely correct for the President to give the date of election under Section 57-1.
