The Chief Justice urges the Supreme Court to recognize past mistakes in endorsing martial laws.

During the Supreme Court Practice and Procedure Act case hearing on Tuesday, Chief Justice of Pakistan, Justice Qazi Faez Isa, made a powerful statement highlighting the devastating impact of unchecked power wielded by certain individuals. He keenly observed that the imposition of martial law often leads judges to forget their solemn oath. In contrast, when laws are enacted by parliament, the judiciary promptly responds, ensuring lawmakers adhere to their oath.

The CJP confidently stated that the Supreme Court should recognize its previous mistakes in endorsing martial laws. Historically, critics, particularly lawyers, have expressed concerns about the perceived misuse of the top court’s jurisdiction under Article 184 (3) of the Constitution of Pakistan.

A complete bench of the Supreme Court, presided over by CJP Isa and including all 15 judges, is currently hearing petitions challenging the SC (Practice and Procedure) Act 2023. This highly anticipated case is being broadcast live on state television, with PTV cameras installed inside Courtroom No.1. The hearing commenced at 9:30 am today.
